Terms and conditions
Introduction
AB Lindex (Lindex) is a Sweden-based, renowned international
fashion retailer with a long standing in the world of fashion
through selling clothes and accessories in high street shops. Due
to extensive consumer demand, Lindex has taken the leap towards
online retailing by offering its international Customers this great
opportunity to shop conveniently from within their homes through
lindex.com.
The following terms and conditions shall be applicable to the
online shopping through lindex.com. Lindex kindly requests its
Customers to read these terms and conditions carefully before
placing any orders. By placing an order, the Customer accepts
Lindex's guidelines for shopping at lindex.com as well as these
general terms and conditions. Naturally, these terms do not affect
the Customer's statutory rights.
Lindex retains the right to amend these terms and conditions on
account of justifiable reasons (e.g. changes in the delivery chain)
by informing the Customers about the amendments by e-mail or on the
lindex.com-website with two weeks notice. The terms and conditions
valid at the time of placing the order shall be applicable to the
order despite possible subsequent amendments.
Prices
All prices are indicated in euro (€) and may be shown, for
convenience, also in some other currencies. The prices are
inclusive of the applicable VAT (value added tax).
As a private individual consumer in the EU, you only pay VAT
once, in the country where you make your purchase. You
can bring home anything you buy in another EU country, without
paying VAT upon receipt or making a
customs declaration. The only condition is that your purchases must
be for your own or your family's personal use, and not intended for
resale.
Prices given on the date when the Customer makes his or her
order are valid throughout the entire purchase process.
Purchase
When ordering goods at lindex.com, a binding purchase agreement
is concluded only after Lindex has confirmed the order to the
e-mail address indicated by the Customer (Order Confirmation).
Confirmation takes place no later than 24 hours after Lindex has
received the order. However, orders placed during Fridays through
Sundays, holiday eves and holidays will be confirmed no later than
on the following business day at 18:00. An order may only be
confirmed provided that Lindex is able to verify the Customer's
residential address.
Items placed in shoppingbag is not reserved. This is not
done before order is placed.
Lindex deliver to Sweden, Norway and the EU countries
Lindex does not deliver to Canary Islands (ES), Jan
Mayen and Svalbard (NO), Ceuta (ES), Gibraltar (GI), Grønland
(GL), Island (IS), Madeira (PT), Melilla (ES) nor the British
Islands
Largest orderamount per purhase is 600 €
Delivery Times and Notifications
Lindex aims that the Goods held in warehouse are dispatched
within seven (7) business days after the sending of the Order
Confirmation. Therefore, the shipment should reach the Customer
within up to approximately ten (10) days. Delivery times are
estimations only and depend mainly on the swiftness of
international and local postal services. During high season (e.g.
Christmas time) deliveries may take somewhat longer than
normally.
Should the delivery be delayed from estimation, the Customer is
entitled to cancel the purchase. In such case, the Customer is
requested to contact lindex.com Customer Service (only in English)
to notify about the cancellation.
The Customer may choose from the following alternatives for
delivery:
1. Pick up from local Lindex store
This option is available currently in the following countries:
Estonia, Latvia, Lithuania, Czech Republic, Slovak Republic and
Poland.
A notification of arrival will be sent to the Customer by e-mail
when the local Lindex store has received the shipment. In case the
Customer has provided Lindex with a mobile telephone number, a SMS
will also be sent to notify about the arrival of the shipment.
When collecting the shipment from Lindex store, the Customer
shall present the Order Confirmation and a valid personal
identification document. The shipment must be collected
within 21 days from the notification of arrival.
2. Direct delivery by UPS
UPS delivers shipments to the address given by the Customer
during the office hours; between 08.00 and 17.00 local time. In
case the Customer normally stays elsewhere during this time, it is
recommended that such delivery address is given where the Customer
is available during the said delivery times.
UPS shall contact the Customer by telephone (secondarily, by
mail) to arrange for the delivery.
Delivery and Service Fee
A standard Delivery and Service fee will be charged on each
order regardless of the number of ordered goods or the destination
of the delivery. This fee is designed to cover the handling,
packing, payment, service and delivery expenses incurred by Lindex
for each order. The standard Delivery and Service fee is ¬
7.00 for all international orders. For conveniency, the Delivery
and Service fee equivalent may be shown in different
currencies.
Lindex.com delivers orders within the European Union (excluding
Finland and Sweden due to the existence of local online-shops).
Should the Customer be uncertain whether Lindex delivers to a
specific location, she/he is requested to contact the Customer
Service.
Deliveries
Lindex delivers each order in one shipment. In case, under
exceptional circumstances, some goods included in the order cannot
be delivered, Lindex shall notify the Customer and deliver the
goods that are available. Goods that could not be shipped shall be
credited to the Customer.
If the parcel has been damaged during the delivery, the Customer
should, without delay, contact Lindex's Customer Service. Lindex
shall ensure that new goods will be delivered to the Customer or
that the Customer will be appropriately credited.
In case of non-collection of the delivery, Lindex reserves the
right to debit the Customer with a charge of ¬ 20.00 to cover the
costs of return freight, extra handling expenses, and payment and
reimbursement expenses.
Payment
Payment can be effected by either credit card or direct debit
(if provided locally).
When paying by a credit or debit card, the Customer shall
indicate his or her card number, CVC code and the validity period
of the card. If possible, the Customer's transaction shall also be
verified by 3D-Secure. The Customer's credit card account will be
charged once the order is ready for dispatch from the warehouse.
Direct debit shall be charged when the Customer has sent and
accepted the order.
All credit and debit cardholders are subject to validation
checks and authorisation by the card issuer. If the issuer of the
Customer's payment card refuses to authorise the payment to Lindex,
the Customer shall receive an error message and a request to use
another means of payment. In this event, Lindex shall not be liable
for any delay or non-delivery of the order, until a valid and
authorized payment has been effected.
Security of Payments at lindex.com
Offering secure payment alternatives is a matter of great
importance to Lindex. Therefore, Lindex uses a card payment system
that has been developed to ensure the best security and protection
for the Customer. All transactions will be sent through SSL (Secure
Sockets Layer) in encrypted form providing high-level security. For
the purpose of Customer protection, Lindex always reserves the
right to control the validity of the card, the availability of the
purchase amount on the account, and the accuracy and correctness of
the Customer's address information. Lindex cooperates with an
authorized payment agent, who processes the Customers card details
in the correct way according to the international security standard
PCI DSS developed by international credit card companies such as
VISA, MasterCard and Diners. Therefore, the Customers card details
and payment information shall be highly protected and processed
with a maximum level of security.

methods of payment, the Customer is advised to contact Lindex's

Right of Withdrawal/Return of Goods
Lindex offers its Customers a 30 days right of withdrawal from
purchase agreement. On sale items Lindex offer 14 days right of
withdrawal. The withdrawal period shall begin from the date of
receipt of the delivery by the Customer.
The Customer is responsible for arranging the return delivery
and paying for the related costs. The return may be carried out as
Store Return or as Postal Return. Store returns are available only
in countries with local Lindex stores.
Store return
The easiest and most economical way to return the goods is to
bring the package to one of local Lindex stores (Store Return).
Returning the goods this way is free of charge for the Customer.
Store Return is possible only if the delivery address of the
original order was in the same country as where the Lindex store is
located.
When returning the goods to a Lindex store, the Customer should
bring with her/him the original delivery note that was enclosed
with the shipment. Only this way can the purchase price and
Delivery and Service Fee be refunded to the Customer.
Postal return
Alternatively, the Customer may arrange the return delivery
through postal services available in her/his area; the package can
be shipped for example as an international priority or economy
shipment, through UPS, DHL, or as an EMS shipment. The delivery
note should be enclosed with the return shipment. The Customer
shall be liable for paying the return delivery costs as well as for
the risk of damage during the transport. The Customer is
recommended to retain the proof of shipment and possible tracking
number until the purchase price has been refunded.

The goods to be returned shall contain original labels, be unused,
in original condition and packed the same way as when delivered.
Lindex requests that the Customer would indicate the reason for
returning the goods.
Bathing suits, underpants and cosmetics must be returned in sealed
packages. Earrings cannot be returned due to hygienic reasons. If
the customer returns only part of the goods, the Delivery and
Service Fee shall not be refunded. Returned goods will be refunded
within 30 days of their receipt by Lindex.
You will be credited to the same account that was used at
purchase.
Exchanges
At this time, Lindex does not offer exchanges through
lindex.com. However, if there are local Lindex stores in the
country where the Customer resides, she/he can exchange one or more
of the goods ordered from lindex.com in the local Lindex
store.
Exchanging goods through a local Lindex store is free of charge,
provided that the exchange is done within 30 days from the receipt
of the delivery by the Customer. When exchanging goods at a Lindex
store, the Customer should bring with her/him the delivery note
enclosed with the original shipment.
The goods to be exchanged shall be returned in unused and
undamaged condition and must contain original labels. The goods
must also be packed the same way as when delivered. When exchanging
bathing suits, underpants or cosmetics, the packages must be
sealed. Earrings cannot be exchanged due to hygienic reasons.
Returned goods will be refunded within 30 days of their receipt by
Lindex.
Notice of Defect
Lindex shall ensure that each dispatch is carefully inspected
before delivery to the Customer. Should the goods nevertheless be
incorrect, damaged or defective upon the receipt by the Customer,
Lindex shall remedy the defect free of charge by replacing such
goods with new goods. The return and replacing of defective goods
does not cause any expenses to the Customer.
To file a notice of defect, the Customer is requested to contact
Lindex s Customer Service by e-mail at customerservice-eng@lindex.com.
When filing a notice of defect, the Customer is required to
indicate the reason for returning the goods. After this, the
Customer should arrange the return delivery through, for example,
local postal services and pay for the return shipping her-/himself.
Also send the receipt for the shipping costs, together with the
defective goods. The Customer shall also be liable for the
risk of damage during the transport. Once Lindex has received the
damaged goods, it will within 30 days refund the Customer for the
costs of the return shipping as well as dispatch the replacing
goods to the Customer, free of charge.
Liability
Lindex retains the right to withdraw from the delivery of the
order in case there has been a clear and obvious price error on the
website (e.g. the price of the product appears to be 0,00 or there
is no price at all). In such case, Lindex shall without delay
inform the customer about the error, notify the correct price and
request from the Customer whether she/he desires to proceed with
the order.
The items sold at lindex.com are provided for private consumer use
only. Any reprint, copying, downloading, storing, transmitting or
similar activity relating to texts and images presented on
lindex.com for any other purpose whatsoever without the prior
written permission of Lindex, is prohibited. Lindex is not liable
for any errors in texts or images and does not accept liability for
any indirect or consequential loss, loss of data, loss of income or
profit, or loss from claims by third parties arising out of the use
of the website or for any products or services purchased from
lindex.com.
Lindex shall have no liability for any delay in the delivery of
products to the extent that the delay is caused by any event
outside of Lindex s reasonable control, including but not limited
to war, flood, fire, labour disputes, strikes, lock-outs, riots,
civil commotion, malicious damage, governmental actions and any
other similar events.
While Lindex aims at as accurate as possible item descriptions and
images on lindex.com, there may be minor colour variations between
the images and the actual products due to a number of factors such
as the used internet browser or the monitor s colour contrast
configurations. Lindex cannot be held responsible for differences
in colours as a result of aforementioned factors.
Lindex shall have the right to interrupt the use of lindex.com at
any time for example on account of maintenance procedures.
Age limit
In order to use lindex.com website, the Customer must be
eighteen (18) years old or more.
Applicable law
These terms and conditions are construed and shall be governed
in accordance with the laws of Sweden.
Personal data
Lindex shall be liable for carefully handling and protecting the
personal data submitted by the Customers or collected through the
Customers' orders or website visits. The corporate entity
responsible for the personal data under the Swedish Data Protection
Act is AB Lindex while other Lindex group companies may have a role
of personal data assistants or processors on behalf of AB
Lindex.
The personal data will be used for managing the purchases, for
marketing purposes, to improve the services and website design and
above all for Lindex to meet its commitments to the Customers. The
data will be used for example to contact the Customer in the event
of delay or problems with the delivery.
Lindex uses the data only within the company group. Lindex never
sells, swaps or passes personal data to third parties for other
purposes than marketing Lindex. Personal data may be forwarded to
carefully selected third parties only to meet Lindex s commitments
to its Customers. For example, Lindex may forward address data to
shipping companies in connection with Customer deliveries.
Personal data is stored only for as long as it is needed in order
for Lindex to perform its services requested by the Customer, for
as long as the customer-relationship is valid, or for as long as
provided by the law.
The Customer has the right to know what personal data is held
about her with Lindex. If the data is incorrect, incomplete, or
irrelevant, the Customer has the right to require the data to me
corrected or removed.
A Customer may, at any time, withdraw her consent to receive
direct marketing mailings. In such case, the Customer is kindly
asked to contact Lindex's Customer Service at customerservice-eng@lindex.com.
